A Manhattan federal court is weighing the first legal challenge to former President Trump’s controversial ’Liberation Day’ tariffs, marking a pivotal moment for U.S. trade policy and executive power. The case, filed by the Liberty Justice Center on behalf of five small businesses, argues that the Constitution grants Congress—not the president—exclusive authority to regulate international commerce.

The Court of International Trade’s ruling could set lasting precedents, as it represents the first judicial review of Trump’s tariff policies. Plaintiffs contend the duties unlawfully harm importers while exceeding presidential authority under the 1977 International Emergency Economic Powers Act. Seven similar lawsuits await resolution, including challenges from 13 states.
